The father of a 23 -year -old has resorted through the foundation of Christian lawyers authorization to practice euthanasia to his daughter Noelia, who does not receive treatment for his mental health problems.
The appeal Antel Superior Court of Justice of Catalonia claims to recognize “the legitimation of the father to resort his daughter’s euthanasia and asks the court to enter the bottom of the matter,” as reflected in a statement from the jurists.

For Christian lawyers, “if the father is not legitimized, the act by which an euthanasia is authorized would become irrecurible, something that does not fit in the Spanish legal framework.”
On the other hand, he denounces that the argument of the court that authorized the homicidal practice that “the father is not related to his daughter is completely false”, a thesis that supports with the testimony of several workers in the centers where Noelia has been hospitalized “that they ensure that the father visits her daily.”
In this sense, Christian lawyers emphasize that it was Noelia’s own father who took her “to declare before the judge the day that was summoned as a witness” in the procedure.
They ask for the nullity of the procedure for “documentary falsehood”
Likewise, on the bottom of the matter, the appeal raises “the nullity of the entire procedure due to documentary falsehood” in which the doctor and the jurist who evaluated the petition of Euthanasia of Noelia would have incurred.
As detailed by the legal representation of the parent, both “pretended a disagreement” to raise the case to the Evaluation Commission of Euthanasia cases. In addition, it is alleged that the procedure was authorized “without complying with the requirements set by law, since Noelia suffers from several mental illnesses that influence its decision and also does not suffer unbearable pain.”
The case of this young woman is the first to be prosecuted since the entry into force of the Euthanasia Law in Spain in 2021.
Since then and until 2023, there have been more than 1,500 applications, of which 697 have been executed through the use of lethal chemical components provided by toilets.
Most of those who request euthanasia in Spain are over 70 years old and suffer oncological and neurological diseases. One in four, they die before the procedure prior to the execution of euthanasia is completed.
