Catholic Church urges to approve new Criminal Code in the Dominican Republic

After more than a century of validity, the Dominican Republic could have a new Criminal Code, so the Catholic Church has urged legislators to commit to their approval before the closing of the current legislature.

On July 21, the Dominican Senate unanimously approved, in second discussion, the bill that seeks to reform the current Criminal Code, originally promulgated in 1884. The initiative was sent to the Chamber of Deputies, which must vote before Saturday, July 26, deadline for the current legislative period.

For decades, several attempts to update the Criminal Code have failed due to the lack of consensus among political parties. One of the most controversial issues has been abortion, whose practice is prohibited in any circumstance in the country.

Article 37 of the Constitution establishes that the “right to life is inviolable from conception to death.” In addition, the current Criminal Code sanctions both medical staff who practice abortions and women who consent, and even those who provide information on how to perform them.

The new bill does not contemplate modifications on this issue, keeping penalties intact.

A Criminal Code “Vetusto and Elder”

The Dominican Catholic Church has called on legislators to act with historical responsibility. Mons. Jesús Castro Mars, Bishop of the Diocese Our Lady of Altagracia, told the deputies that “they have the historical commitment to bequeathed, finally, a criminal code.”

If approved without modifications, the regulations will pass to the Executive Power for its promulgation. Otherwise, the text will return to the Senate. If promulgated, the new Criminal Code will enter into force a year later, in order to facilitate its implementation in the judicial system.
