They present in Colombia projects to protect the unborn and strengthen families

On July 30, two bills were presented in the Senate of Colombia, one to recognize the child who is in the mother’s breast as a “subject of rights” and another to eradicate domestic violence.

These are projects Nasciturus peacefully (Invisible Children Law) and United Families, United Society. Both are initiatives of Senator Mauricio Giraldo and representative Luis Miguel López Aristizábal.

The two texts were filed in the First Senate Commission, with the accompaniment of several congressmen of the Provida bench and in the presence of the Secretary General of the Senate, Diego González.

Invisible Children Law

A note shared with ACI Press notes that despite the fact that science “has shown that life begins with fertilization and the Constitution recognizes the right to life as inviolable,” the Colombian legal system only grants “legal personality at the born born.

“This law seeks to close that emptiness and ensure that the child in gestation is recognized as a subject of rights” and enjoyment of protection and care in the health system “as a patient from the womb.”

To do this, the objective is to modify articles 90 and 93 of the Civil Code, “eliminating the condition of ‘birth with life’ for the recognition of fundamental rights such as life, integrity and state protection.”

Provida parliamentarians point out that “denying rights to Nasciturus contradicts article 11 of the Constitution, the American Convention on Human Rights and the Convention on the Rights of the Child”, in addition, “abortion cannot be considered a ‘right’, since it implies the suppression of another human life”.

In that sense, they affirm that “recognizing rights to the child in gestation strengthens, does not weaken, the rights of women, and promotes a society that protects the most vulnerable.”

United Families, United Society

For its part, the project to eradicate domestic violence seeks to promote “comprehensive public policies, effective care routes and strategies that promote protection environments and healthy family relationships.”

In their note, Provida parliamentarians indicated that only in 2023 were reported in Colombia “more than 134,000 cases” of violence within households, “especially affecting women, children and older adults.”

“This problem breaks the social fabric and perpetuates cycles of abuse and suffering,” they said.

In that sense, the project United Families, United Society It establishes the creation of “a specific route to detect and address family violence within the health system”, the design of “a comprehensive program from the Ministry of Health to intervene in cases of family violence that impact mental health”, among other measures.

To become law, both projects must overcome two debates in the Senate: in the First Commission and before the plenary; and then be sent to the House of Representatives to follow the same process.

In the case of the Invisible Children Lawbeing a statutory bill, the four debates must be carried out in this legislature that expires on July 16, 2026.

Instead, the initiative United Families, United Society It is an ordinary bill, so it is enough that it exceeds a debate to remain in force one more legislature.
