In addition to the profound changes in the Automotive Ownership Registry, Mieli’s DNU also seemed to establish changes in the mandatory documentation for driving a car. However, it is important to clarify that current requirements such as proof of insurance and VTV They are still mandatory to circulate.
The confusion is in article 22 of the DNU, which does not even mention the automobile insurance or VTV as mandatory documents to circulate, while reference is made to the payment of the last license plate of the vehicle. This article, however, is directly related to the changes in the automotive registration system, not to the requirements established by the Traffic Law.
The DNU indicates that article 22 of Decree-Law No. 6582/58 ratified by Law No. 14,467 (to 1997), and its amendments, is replaced, but it never refers to the Traffic Law.
Its text indicates: “Without prejudice to the issuance of the title referred to in article 20, together with the original registration, or with each of those corresponding to successive transfers of ownership, the Registry will deliver to the owner of the vehicle one or more identification cards. of its identification, in which the data that, with respect to the vehicle and its owner, establishes the enforcement authority, will be recorded.
“The cards will be delivered digitally, which will have the same validity as the physical ones. The purchaser may request one or more physical cards, which may have a cost. These cards must be returned by the transferor of the vehicle, issuing new ones for the purchaser. Their possession “will prove the right or authorization to use the vehicle, but will not exempt from the obligation to justify personal authorization to drive.”
“The identification card, the driver’s license and the proof of payment of the license plate are the only documents required to circulate with the vehicle, and the provincial or municipal authorities will not be able to establish other requirements for its legitimate use. It will be mandatory to exhibit these documents to the competent authority, but they cannot be detained if there is no report of theft or theft of the vehicle or an order from a judicial authority.”
What the Traffic Law 24,449 establishes
In its article 68, the Law establishes that “Every motor vehicle, coupled or semi-coupled, must be covered by insurance, in accordance with the conditions established by the insurance authority, which covers possible damages caused to third parties, whether transported or not. Likewise, insurance will be mandatory for motorcycles under the same conditions that apply to automobiles.”
“This mandatory insurance will be annual and may be contracted with any entity authorized to operate in the field, which must provide the insured with the proof indicated in section c) of article 40. Previously, compliance with the mandatory technical review will be required or that the vehicle is in regulatory safety conditions if this has not been carried out in the previous year.”
Journalists and a legislator who do not know the law say that the #DNU ended the mandatory #safe and the #VTV. Error: Law 24449 was not touched. They are still mandatory. These requirements do not appear in the registration regime modified by the DNU.
